General Terms and Conditions of Sale


Designation

The company Amalingo is a professional training organization with its registered office at 3 Le Champ Guy, 56350 Béganne.

Amalingo provides and delivers inter- and intra-company training programs, remotely, throughout the national territory, either independently or in partnership.

For the purposes of the following paragraphs, the following definitions apply:

  • Client: Any individual or legal entity that registers for or orders a training course from Amalingo.
  • Trainee: The individual who participates in a training course.
  • GTCS: The General Terms and Conditions of Sale outlined below.
  • OPCO: The accredited skills operators responsible for collecting and managing companies’ training contributions.


Purpose and scope

These General Terms and Conditions of Sale define the terms applicable to training services provided by Amalingo on behalf of a client. Any training order placed with the company implies the client’s full and unconditional acceptance of these General Terms and Conditions of Sale. These conditions take precedence over any other client document, including general terms of purchase.

Quotation and certification

For each training course, Amalingo undertakes to provide a quotation to the client. The client must return a completed, dated, signed, and stamped copy with the mention "Approved".

If necessary, a specific agreement may be established between Amalingo, the OPCO, or the client.

Upon request, the client may receive a certificate of attendance or completion of the training, as well as attendance sheets.

Prices and terms of payment

Training prices are exempt from VAT. However, other products and services are quoted in euros, excluding VAT, and are subject to the applicable VAT rate. Payment must be made upon receipt of the invoice, in full. Invoices can be settled by bank transfer or check. In exceptional cases, installment payments may be arranged. In any event, the terms must be formalized before the training begins.

Funding support by OPCO

If the client benefits from funding through an OPCO, they must apply for funding before the training starts. The client must provide proof of funding at the time of registration. If Amalingo does not receive confirmation of OPCO funding by the first day of training, the full training cost will be invoiced to the client.

Rescheduling, cancellation, and absence management

FULL TRAINING CANCELLATION OR RESCHEDULING

The client may cancel or reschedule a training session under the following conditions:

  • Cancellation free of charge: Any cancellation made at least 10 calendar days before the scheduled start date and time incurs no penalty.
  • Cancellation between 4 and 10 business days before the training start date: A penalty of 10% of the total initial cost will apply.
  • Cancellation less than 3 business days before the training start date: A penalty of 50% of the total initial cost will be charged.

Any cancellation or rescheduling request must be sent by email to karen@amalingo.fr.

In the event of unforeseen circumstances or force majeure preventing the training from taking place, Amalingo shall not be held liable. Clients will be notified by email as soon as possible.


SESSION CANCELLATION OR ABSENCE DURING A TRAINING COURSE

For training programs organized by Amalingo, active participation is essential to ensure pedagogical continuity and program effectiveness. Attendance tracking is mandatory for all sessions.

  • Unreported absence or cancellation within 24 hours before a session will be fully charged with no possibility of rescheduling.
  • Exceptional rescheduling: As a goodwill gesture and subject to availability, Amalingo may offer a session rescheduling if requested in writing at least 24 hours in advance.

The client company must inform Amalingo in writing of any anticipated absence. The cooperation of the company is essential to ensure the smooth running of the training sessions and compliance with funding obligations. Any unreported absence will result in an email notification to the absent participant and the client company.

WITHDRAWAL FROM TRAINING

If a trainee withdraws from the training course, Amalingo will contact both the trainee and the client company to assess the situation and propose, if possible, appropriate corrective measures.

Training program content

The instructor may modify the training content as necessary based on current events, group dynamics, or participants’ levels. The program descriptions provided in course materials are therefore indicative only.

Intellectual property and copyright

All training materials, regardless of format (paper, digital, electronic, etc.), are protected by intellectual property laws and copyright regulations. Any partial or complete reproduction is prohibited without the express consent of Amalingo. The client agrees not to use, distribute, or reproduce any part of these materials for training delivery or facilitation purposes.

Data protection and privacy

Personal data provided by the client to Aamalingo is necessary for order processing, service execution, and service improvement. Data may also be used for communication and marketing purposes, subject to the client’s prior consent.

In accordance with the French Data Protection Act of January 6, 1978, the client has the right to access, rectify, and oppose the processing of their personal data. Requests can be made in writing to team@amalingo.fr.

Amalingo commits to implementing appropriate administrative, physical, and technical measures to protect the security, confidentiality, and integrity of client data. The company will not disclose client data unless legally required.

Applicable law and jurisdiction

These General Terms and Conditions of Sale are governed by French law. In case of a dispute between Amalingo and the client, an amicable resolution will be sought as a priority. If no agreement is reached, the case will be submitted to the courts of Vannes.
